General terms and conditions of sale

Article 1 - Scope of application

These general terms and conditions of sale apply, with no restrictions or reservations, to all sales made by SARL HANNA ("the Vendor") to non-professional purchasers ("the Customer") who wish to acquire the products offered for sale by the Vendor ("the Products") on the www.ferret.fr website.

They notably specify the terms and conditions for placing an order, payment, delivery, and managing any potential returns for Products ordered by the Customer. The Products offered for sale on the www.ferret.fr website are the following: Timepieces, wedding rings, pendants, bracelets, rings, solitaire designs, and earrings.

The main Product features and in particular the specifications, illustrations, and product dimensions or capacities are available on the www.ferret.fr website.

The Customer is advised to consult them prior to placing an order.

The choice and purchase of a Product is the Customer’s sole responsibility.

The Customer is expected to refer to the description of each Product to obtain information about its properties and essential characteristics.

Product promotions are subject to availability, as specified when the order is placed.

These general terms and conditions of sale apply, to the exclusion of all other terms and conditions, in particular, those applicable to sales in-store or through other distribution and marketing channels.

These general terms and conditions of sale can be consulted at any time on the www.ferret.fr website and shall prevail, where appropriate, over any other version or any other contradictory documentation.

The Customer declares that they have read these general terms and conditions of sale and have accepted them by ticking the box provided prior to placing an order online, together with the general terms and conditions for using the www.ferret.fr website.

These general terms and conditions of sale may be subject to subsequent modifications. Consequently, the version applicable to the Customer's purchase is the one in force on the website on the date the order is placed.

In the absence of proof to the contrary, the data stored in the Vendor's IT system constitutes proof of all transactions concluded with the Customer.

In accordance with the French Data Protection Act of 6 January 1978, the Customer has the right to access, rectify and oppose all of their personal data at any time by writing, with proof of ID, to SARL HANNA - 2, Rue de Verdun, 06000 NICE.

By confirming the order, the Customer accepts these general terms and conditions of sale with no restrictions or reservations.

The Customer acknowledges that they have the means required to contract and acquire the Products offered on the www.ferret.fr website.

For orders placed for countries other than mainland France, the Customer is deemed to be the importer of the Product(s) concerned.

Customs duties or any other local taxes, import duties or state taxes may be payable. They shall be borne and are the sole responsibility of the Customer.

In the event of a sale abroad, it is advisable to find out about the laws applicable in the country concerned, to ensure compliance with any constraints that may be imposed, and to translate the terms and conditions of sale into the appropriate language.

Any amendments to these general terms and conditions of sale are effective for www.ferret.fr website users from the date they are posted online and cannot be applied to transactions previously concluded.

Article 2- Orders

It is the Customer's responsibility to select the Products they wish to order on the www.ferret.fr website, as follows:

Click on the "Add to Basket" button
Consult the basket and choose the delivery method
Entering invoicing and delivery details
Choose the payment method and enter the payment information
Confirm the payment

The contractual information is presented in French and is subject to confirmation no later than the time the Customer confirms their order.

Product promotions are valid as long as they are visible on the website, within the limits of available stocks.

The sale is deemed to be complete only after the Vendor has sent the Buyer confirmation of acceptance of the order by e-mail after the Vendor has received the full purchase price or the full deposit due.

It is the Customer's responsibility to check the accuracy of the order and to report any errors immediately.

Any order placed on the www.ferret.fr website constitutes a contract agreed between the Customer and the Vendor at a distance.

The Vendor reserves the right to cancel or refuse any order from a Customer with whom there is a dispute over the payment of a previous order.

The Customer can track the status of their order on the www.ferret.fr website.

The Vendor does not intend to sell any Products on the www.ferret.fr website to trade professionals and to sell exclusively to consumers, for their personal requirements.

The Vendor, therefore, reserves the right to refuse any order for the same product in a larger quantity consisting of more than 5 identical pieces. It also reserves the right to refuse or cancel any order in the event of a pricing error, particularly if the price displayed is significantly different from the actual, potentially derisory price.

Any changes to the order made by the Customer shall only be taken into account by the Vendor within the scope of its capacities and on the condition that the Vendor is notified by e-mail at least 2 days prior to the date on which the order is to be dispatched.

In the event that the Vendor is unable to accept these changes, the sums paid by the Customer shall be refunded to the Customer within a maximum period of 30 days from being notified of the Vendor’s inability to meet the Customer's request for changes (unless the Customer prefers to receive a credit note).

In the event of an order being canceled by the Customer after it has been accepted by the Vendor less than 2 days prior to the date specified for delivery of the Products ordered, for any reason whatsoever other than exercising the right of withdrawal or force majeure, a sum corresponding to 10% of the total amount of the purchase may be due to the Vendor and invoiced to the Customer in compensation for the loss incurred.

Article 3 - Pricing

Products are supplied at the prices listed by the Vendor on the www.ferret.fr website at the time the order is placed. All Prices are expressed in Euros, excluding VAT, and including VAT.

Prices take into account any discounts offered by the Vendor on the www.ferret.fr website.

These prices are fixed and cannot be revised during their period of validity, as stated on the www.ferret.fr website. Outside this period of validity, the Vendor reserves the right to modify prices at any time. Prices do not include the costs of processing, shipping, transport, and delivery, which are invoiced in addition, under the terms and conditions specified on the www.ferret.fr website and calculated prior to placing the order.

The payment the Customer is requested to pay corresponds to the total amount of the purchase, including these costs.

An invoice is generated by the Vendor and given to the Customer upon delivery of the Products ordered.

Article 4 – Payment terms

The price is payable in full on the day the order is placed by the Customer, using a secure payment system, with the following bank cards: Visa, MasterCard, American Express, and another debit/credit cards.

All payment data is encrypted using SSL technology.

The Seller offers its Customers the Alma credit service for the settlement of their purchases and the execution of the payment. This is conditioned by the Customer's acceptance of the GCU or of the credit contract proposed by Alma.
Any refusal by Alma to grant credit for an order may result in the cancellation of the order.
Any termination of the GTC binding the Customer and the Seller entails the termination of the GTC or the credit contract between Alma and the Customer.
The payment three / four times is available via our partner Alma. The security of the payments is ensured by Alma and its providers. All payments are protected by 3D Secure.
Amount of the purchases:
Only purchases between 200 euros and 6000 euros are eligible for payment with Alma
Fees: When paying in several installments with Alma, the Customer does not pay any fees except in the following cases:

For the 10 times payment (only purchases between 1500 euros and 6000 euros are eligible for the 10 times payment with Alma): 3% fee.
Alma is a tele-payment manager and delivers an electronic certificate that will be worth proof of the amount and date of the transaction in accordance with the provisions of article 1316 and following of the civil code.
Termination: Any termination of the GTC binding the Seller and the customer, entails the termination of the GTC between Alma and the customer.

The amount is paid by a credit granted by Alma SAS registered on the REGAFI under the number 90876.
Payment: The payment by credit is available for the payment of their purchases via our partner Alma, the execution of the payment is conditioned by the signature of the credit contract proposed by Alma. The Seller accepts in advance the granting of credit concluded between Alma and the customer in accordance with article L312-46 of the consumer code. If Alma agrees to grant the credit to the customer, the amount will be paid by credit in accordance with article L312-45 of the consumer code. Any refusal by Alma to grant credit for an order may result in the cancellation of the order unless the customer agrees to pay cash. Any cancellation of the GTC binding the Seller and the Customer entails the cancellation of the credit contract between Alma and the customer. In case of withdrawal, the costs and interests of the Customers will be refunded in accordance with the regulations.
Security: The security of the payments is ensured by Alma and its providers. All payments are protected by 3D Secure. Alma is a tele-payment manager and delivers an electronic certificate which will be worth proof of the amount and date of the transaction in accordance with the provisions of articles 1316 and following the civil code.
Particular case: In case of a contract of sale or provision of services with successive execution or delivered within a long period of time, the Seller must specify in its GTC the moment of the beginning of the delivery or the provision of the services. Article 5 - Deliveries

The Products ordered by the Customer will be dispatched to mainland France and to countries in Europe within 2 working days of the order being placed. In addition to this preparation time, the time required for processing and delivery to the address indicated by the Customer when placing the order on the www.ferret.fr website is also added.

Delivery is defined as the physical possession or control of the Product being transferred to the Customer.

Except in special cases or when one or more Products are unavailable, the Products ordered will be delivered in a single consignment.

The Vendor undertakes to make its best efforts to deliver the products ordered by the Customer within the time limits specified above. Nevertheless, these deadlines are only given as an indication. However, if the Products ordered have not been delivered within 30 days after the estimated delivery date, for any reason other than force majeure or due to an error by the Customer, the purchase may be canceled on the Customer's written request under the terms of articles L 216-2L 216-3L241-4 of the French Consumer Code. The sums paid by the Customer will then be refunded to them within a maximum of fourteen days, following the date of cancellation, with no indemnity or deduction incurred.

The Vendor also offers free delivery to the FERRET store based in NICE (06000) - 2, rue de Verdun.

The Vendor recommends checking the Product upon receipt. In the event that the Product supplied does not conform to the order (such as the wrong product supplied, or a defective, damaged, or incomplete Product), the Buyer is advised to notify the carrier and/or the Vendor in writing, within five (5) days of receiving the delivery.

In all cases, the provisions set out in Article 9 regarding legal guarantees shall apply.

For Products reported to be non-conforming within five (5) days of delivery, the Vendor offers the option of exercising your right of withdrawal and obtaining a refund for the Product without needing to repair or replace it, as provided for by the legal guarantee of conformity.

Article 6 - Transfer of ownership - Transfer of risks

Transfer of ownership of the Vendor's Products occurs upon the Vendor's acceptance of the order, representing the parties' agreement on the goods and on the price, regardless of the date of payment and delivery.

Article 7 - Right of Withdrawal

In accordance with the applicable legal provisions, the Customer has a period of fourteen days from receiving the Product to exercise their right of withdrawal by returning it to the Vendor, without having to give any reason or pay any penalty, for the purpose of exchange or refund, provided that the Products are returned in their original packaging and in perfect condition within 14 days of the Vendor being notified of the Customer's decision to withdraw.

Products must be returned in their original state and complete (with packaging, accessories, instructions, etc.) to enable them to be resold as new, accompanied by the purchase invoice.

Any damaged, soiled or incomplete products will not be accepted.

The right of withdrawal may be exercised by e-mail or by post, using the withdrawal form provided by clicking here. The Vendor will immediately notify the Customer of receipt of the form in writing or any other statement, clearly expressing the Customer's wish to withdraw from the contract.

If the right of withdrawal is exercised within the aforementioned period, only the price of the Product(s) purchased and the delivery costs shall be refunded. The cost of returning the Product(s) shall be borne by the Customer.

The exchange (subject to availability) or refund will be made within 14 days of the Vendor receiving the products returned by the Customer under the conditions set out in this article.

Article 8 - The Vendor's liability - Warranty

The Products offered for sale on the www.ferret.fr website comply with the current regulations in force in France and have compatible performance for non-professional use.

The Products supplied by the Vendor benefit automatically and without additional payment, independently of the right of withdrawal, according to the legal provisions:

- the legal guarantee of conformity, for apparently defective, spoiled or damaged Products or Products that do not correspond to the order

- the legal guarantee against hidden defects resulting from a material, design or manufacturing defect that affects the products delivered, making them unfit for use

under the conditions and according to the methods defined in the appendix to these general terms and conditions of sale (Guarantee of Conformity / Guarantee of Hidden Defects).

In order to assert their rights, the Customer must inform the Vendor, in writing, of non-conformity of the Products within a maximum period of 2 years from the date of delivery of the Products, or the existence of hidden defects within a maximum period of 2 years from the date of their discovery.

The Vendor will refund, replace or repair any Products or parts under guarantee that are found to be non-conforming or defective.

The shipping costs will be refunded based on the invoiced price.

 

Refunds for Products deemed to be non-compliant or defective shall be made as soon as possible and within a maximum of 30 days from the Vendor's acknowledgement of the non-conformity or hidden defect.

Refunds will be credited to the Customer's bank account or by banker's cheque sent directly to the Customer.

The Vendor shall not be held liable in the following cases:

- non-compliance with the legislation of the country to which the products are delivered, which is the Customer's responsibility to check

- in the event of misuse, use for professional purposes, negligence or lack of maintenance on the part of the Customer, as well as in the event of normal wear and tear of the Product, accident or force majeure

The Vendor's warranty is, in any event, limited to replacing or refunding Products that do not conform or are affected by a defect.

Article 9 - Data Protection and Privacy

In application of law 78-17 of 6 January 1978, it should be noted that the personal data requested from the Customer is required for order processing and in particular for preparing invoices.

This data may be communicated to any of the Vendor's partners responsible for fulfilment, processing, management and payment of orders.

Data processed via the www.ferret.fr website is registered with the CNIL (French Data Protection Authority).

In accordance with national and European regulations in force, the Customer has a permanent right of access, modification, rectification and opposition in relation to any information concerning them.

This right can be exercised under the terms and conditions specified on the www.ferret.fr website.

You have the option of registering for free on a BLOCTEL (www.bloctel.gouv.fr) telemarketing opposition list to ensure you are no longer contacted by any company which you have no current contractual relationship, in accordance with Article L. 223-2 of the French Consumer Code.

Article 10 – Intellectual property

The content of the www.ferret.fr website is the property of the Vendor and its partners and is protected by French and international laws relating to intellectual property.

Any total or partial reproduction of this content is strictly forbidden and is likely to constitute an infringement of copyright.

In addition, the Vendor retains ownership of all intellectual property rights to any photographs, presentations, studies, designs, models, prototypes, etc., produced (even at the Customer's request) with a view to providing services to the Customer. The Customer shall therefore refrain from reproducing or exploiting the said studies, designs, models and prototypes, etc., without the Vendor's express, written and prior authorisation, which may be subject to a financial contribution.

Article 11 - Applicable law - Language

The present general terms and conditions of sale and related transactions are governed by and subject to French law.

The present general terms and conditions of sale are written in French. In the event that they are translated into one or more foreign languages, only the French text shall be deemed authentic in the event of a dispute.

Article 12 - Litigation

Any disputes that may arise from the purchase and sale transactions concluded in accordance with these general terms and conditions of sale, concerning their validity, interpretation, execution, termination, effects and consequences, and which cannot be resolved between the Vendor and the Customer, shall be submitted to the competent courts under the conditions of common law.

The Customer is informed that they may at any time have access to a mediation service, notably with the Consumer Mediation Commission (Article L 612-1 of the French Consumer Code) or with the existing industry mediation bodies, details of which can be found on the www.ferret.fr website, or any alternative method of settling disputes (such as conciliation) in the event of a dispute.

Article 13 - Pre-contractual information - Customer acceptance

The Customer acknowledges having been made aware of these general terms and conditions of sale and of all the information listed in article L 221-5 of the French Consumer Code, in a legible and comprehensible manner, prior to placing the order and concluding the contract. Such information includes the following:

the essential features of the Product, taking into account the advertising medium used and the Product concerned
the price of the Products and related costs (e.g. delivery)
in the absence of an immediate fulfilment of the contract, the date or period within which the Vendor undertakes to deliver the Product

information on the identity of the Vendor, its postal, telephone and e-mail contact details, and its business activities, if not apparent from the context,

•    information relating to legal and contractual guarantees and their implementation

the functionality of digital content and, where applicable, its interoperability
the possibility of resorting to a mediation service in the event of a dispute
information on the right of withdrawal (existence, criteria, time limits, procedures for exercising this right and standard withdrawal form), the cost of returning Products, cancellation procedures and other important contractual terms
the payment methods accepted

For an individual (or a legal entity) to place an order on the www.ferret.fr website implies full acceptance of these general terms and conditions of sale and an obligation to pay for the Products ordered, which is expressly recognised by the Customer, who notably waives the right to invoke any contradictory documentation which would not be unenforceable on the Vendor.

Article 14 – Promotional codes

Promotional codes do not apply to the following brands, unless explicitly stated otherwise on the product concerned:

Tudor, Bulgari, Chaumet, Dinh Van, Messika, Le Gramme, Panerai & Marie Lichtenberg

The Ferret2021 code entitles you to a discount on your first purchase on the www.ferret.fr website. This code applies to a selection of products. This selection may be modified at any time. The code cannot be used in conjunction with any current promotions, discounts or other promotional codes.

Article 15 - Engraving, configurable and personalised products

1. Configurable Products

The majority of the items offered for sale on the website can be configured according to your requirements and desires (colours, sizing, adjustments, etc.).

For each product selected and prior to completing the order, you are invited to carefully configure your items.

In addition to the overall configuration, you also have the option to request a personalised configuration. For any personalised configuration that is not offered on the website, please contact our Customer Service team directly.

2. Withdrawal and Refund Waiver

In the event that an item selected has been engraved or customised (such as the cord colour, engraving, or specific requests), you expressly waive the right to be refunded or to withdraw from your purchase under the conditions of Article 10 below, in accordance with Article L. 221-28 of the French Consumer Code, according to which "the right of withdrawal cannot be exercised for contracts : [...] 3° for the supply of goods made to the consumer's specifications or which are clearly personalised".

Therefore, by requesting a personalised engraving or configuration, you acknowledge that no refund will be given and that you will not be able to withdraw from your purchase.
